Mission: 

Mental Armor seeks to help our community build resilience by sharing knowledge and resources about mental health.

To develop mental armor by increasing awareness and promoting tools to strengthen mental resilience and reduce burnout, suicide, and mental health issues.

Terms of Use Agreement 

This Terms of Use Agreement (hereinafter, the "Agreement"), states the terms and conditions under which you may use this web Site (the "Site").  Please read this Agreement carefully.  This Site contains various information relating to Mental Armor (herein, the “MA”), as well as links provided to third-party Sites, in the form of text, graphics, news, reports, videos, and other materials, which are tangible or intangible (hereinafter, the "Content").  This Agreement is between “you,” as the user, and “us,” “we,” and “MA” as the Site owner and provider. By accessing, browsing and/or using this Site, you acknowledge that you have read, understood, and agreed to be legally bound by this Agreement.  If you do not accept this Agreement and therefore do not agree to by bound by this Agreement, do not use this Site.

MA practices and policies with respect to the collection and use of personally identifiable information is governed according to the Mental Armor Privacy Policy, also found on the footer of our Site. 

Termination

MA reserves the right, in its sole discretion, to amend, restrict, suspend, or terminate this Agreement, without any prior or advance notice, and your access to all or any part of our Site or the Content, at any time and for any reason without liability. FURTHER, MA reserves the right to change, suspend, or discontinue all or any part of this Site or the content at any time without prior notice or liability.

User Must Comply with Applicable Laws

This Site is based in Texas.  MA makes no claims concerning whether the Content may be downloaded or are appropriate for use outside of the United States.  If you access this Site from outside of the United States, you are solely responsible for ensuring compliance with the laws of your specific jurisdiction. 

Miscellaneous 

If any portion of the Agreement is held to be invalid or unenforceable, the judicial or arbitral forum is expressly authorized to modify such invalid or unenforceable portion and construe in accordance with the applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the Agreement shall remain in full force and effect.  The paragraph headings herein are provided only for reference and shall have no effect on the construction or interpretation of the Agreement.  MA's failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of its right to subsequently enforce such provision or any other provision of this Agreement.  Neither the course of conduct between you, us, or any other parties, nor trade practices, shall act to modify any provision of the Agreement. 

Governing Law and Venue

The Agreement shall be governed by and construed in accordance with the laws of the State of Texas., without regard to any conflicts of law rules.  Any action relating to, or arising out of, the Content, Site, or these Terms must be brought in Texas., and you hereby irrevocably consent to the jurisdiction of Texas and its courts.  Venue for any action shall be in Tarrant County, Texas. 

Agreement to Arbitrate

By using this Site, you expressly agree to submit any and all causes of action and legal claims to be submitted to mediation before the Tarrant County Mediation Service, Texas.  If all issues are not resolved by mediation, then the disputing party may request arbitration before the American Arbitration Association, subject to the consumer arbitration rules. You expressly agree that arbitration will be the exclusive forum to resolve any said causes of action or legal claims. Any cause of action or claim you may have arising out of the use of this Site or this Agreement, directly or indirectly, must be commenced within one (1) year after the claim or cause of action arose, or be time barred. This Agreement contains the entire agreement of the parties for this Site and supersedes all existing agreements and all other oral, written or other communication between the parties concerning its subject matter.  You agree to use the Content and Site only for lawful purposes. You are prohibited from any use of the Content or Site that would constitute an illegal offense, give rise to liability, or otherwise violate any applicable local, state, national or international law or regulation.

Mental Armor respects the intellectual property rights of creators. If you believe that a posting (generally from a contributor) violates a copyright or other intellectual property right, the designated agent to receive notification of claimed infringement under the Digital Millennium Copyright Act is at DMCA@MentalArmor.org. 

Mental Armor and Empower Texas are assumed names of Empower Fort Worth, Inc., a Texas nonprofit corporation, registered with the IRS as a tax-exempt 501(c)(3), and dba herein as MentalArmor.org.
